Music Law – Legal Practices in the Music Industry  

Introduction:

This research portfolio will be principally concerned with the following topics: What is a music lawyer? what specialised skills do they need to succeed in their profession? what are their duties & responsibilities to their clients? what are the fundamentals of copyright law? and career opportunities are available to music lawyers? Before I start regurgitating information from a handful of sources, I will also dedicate some time to explaining what exactly Music law is and briefly explain how it fits into the broader legal practice of Media Law. The terms Media law and Entertainment law are often used interchangeably, but for the purposes of this research portfolio, and for the sake of simplicity I will only refer to it as Media law.

A brief explanation of Music and Media law:

Music law regulates the creation, production, distribution, and ownership of music. This particular branch of the legal profession ensures creators, such as songwriters, musicians and producers are properly compensated for their work and maintain control over how their work is used by others, whether that is through licensing or performance rights. The key areas of music law are as followed:

Copyright Law – A copyright grants exclusive rights to the owners for the copying, adapting, and distributing of their work.

Trademark Law – Safeguards brands (i.e. band names, logos, and other merchandise) from unauthorized use.

Contract Law – Within the music industry contracts form the foundation for many agreements, for instance for recording, publishing, and licensing.

Licensing – Crucial for obtaining permission (Licenses) to use copyrighted material.

Performance Rights – Protects a performer’s live or recorded performances from unauthorized use.

As I stated above, Music Law belongs to the broader legal practice of media law. Media Law encompasses the legal regulations and frameworks which govern the collection, dissemination, and consumption of information across various media platforms. In simpler terms, media law determines what can and cannot be published/ broadcasted, along with protecting the rights to whomever created and/or owns that piece of media. Having a comprehensive understanding of Media Law is crucial to any aspiring music lawyers, as it will assist them in navigating the complexities of the contemporary media landscape, whilst also helping them to adhere to the legal and ethical standards, chief among which are: freedom of speech, censorship, intellectual property rights and media ethics.

Music Lawyers:

A music lawyer is a legal practitioner who plays a vital role in helping musicians, artists, songwriters, producers, etcetera. to navigate and better understand their legal surroundings. Not only do they provide legal guidance to their clients, but they also protect them from potential revenue losses and career failings.

Educational & Professional requirements:

Like with most professions, to become a music Lawyer a series of academic and professional requirements need to be fulfilled. Obtaining a bachelor’s degree is the minimum educational requirement. A bachelor’s in the Arts, Economics, Law, Political Science or Music Business are all subjects which would be of particular relevance to those wishing to persue Music Law.

In addition to traditional law degrees, some students may also pursue a specialized Master of Laws (LLM) in a field like intellectual property law, contract law or media law. While not mandatory, these additional qualifications can enhance an aspiring music lawyer’s credibility and equip them with a specialized understanding of the legal issues faced by artist, record labels and publishers.

As for professional qualifications, that would usually consist of the passing of the Solicitors Qualifying Examination (SQE) followed by a two-year training contract with a law firm, ideally one that specializes in Intellectual Property or Media Law. “Engagement in internships, volunteer opportunities, or any practical legal experiences within the music sector can further enrich one’s education.” (USA Trusted Lawyers, 2025) Such endeavours offer invaluable real-world exposure and networking opportunities. Building relationships with established practitioners within the field, along with industry professionals like musicians and producers, can lead to potential job opportunities or referrals.

Essential skills and knowledge for success within the profession:

To ensure their success within the music industry, an aspiring music lawyer must familiarise themselves with several critical areas of specializations:

Copyright law – A solid understanding of copyright law is of paramount importance to this branch of the law. A music lawyer must be adept at identifying what constitutes copyrightable material, be competent at managing the registration of copyright claims and have a robust knowledge of fair use doctrines. Allen Bargfrede (2021:16) outlines the two types of copyright which a music lawyer must be familiar with:

There are two copyrights vital to the music business, protecting every recorded song:

1)The copyright in the musical composition – the lyrics and the music; and

2) The copyright in the sound recording – the actual recorded performance of a particular musical composition.

This knowledge will assist clients in securing the protection of their intellectual property, minimize infringement risks and maximize their creative output.

Contract negotiation – To advocate effectively for their clients’ interests, ensuring equitable terms that reflect the artist’s value in the marketplace. A music lawyer must have a comprehensive understanding of contract law.

Litigation – Disputes occur on a regular basis within music industry. An artist’s career and financial stability could be jeopardised if a music lawyer is not equipped to effectively manage these disputes. Thus, underling the importances of skilled legal representation in court.

Effective communication – In order to foster trust with a client, and to ensure they are properly informed about their rights and options when entering into any negotiations. A music lawyer must be able to convey complex legal concepts in manner that is understandable to their clients.

Adaptability – In a fast-paced and ever-changing industry, music lawyers must remain flexible to tackle the evolving challenges with which they are presented.

Copyright Law and Copyright Infringement – Allen Bargfrede (2021:13) defines copyright as follows:

Copyright is the right of a creator to control various uses and distributions of his or her creations. It is copyright that protects the music created and the creators to make money from such music. Without copyright, there would be no recorded music industry.

One of the most frequent causes for disputes within the music industry is the unauthorized use of copyrighted material, this is called copyright infringement. Those accused of infringement may face severe legal action if they are found guilty of the following: Using copyrighted music without permission, the creation of derivative works or the illegal distribution of copyright music.

Contract Law – Contracts in the music industry outline the terms of an agreement between an artist and a label. “Key elements of a music contract include the scope of the agreement, compensation and royalties, and the term of the contract.” (Purple Fox Legal, 2023).

Emerging Technologies – With the emergence of AI generated music, music lawyers are presented with a whole host of new challenges, with this music lawyers must stay up to date on how existing laws apply to emerging technologies, like AI. The correct enforcement of copyright laws and the protection of their client’s intellectual property is their main concern here.

Litigation – Litigation is the act by which a lawsuit is brought into court to resolve any dispute or to enforce a specific right. Music lawyers are responsible in resolving the following dispute:Royalty conflicts, copyright/IP enforcement, internal band disagreements, and action against counterfeiters.

The main financial issues are as follows:

Royalty collection and revenue streams – Ensuring that clients are paid correctly is a major challenge faced by music lawyers. They endeavour to close any loopholes in contracts that might otherwise withhold a substantial portion of an artist’s income.

Cost of legal services – In order for emerging artists to afford the services of an experienced music lawyers, some lawyers are prepared to work on a commission basis, usually 5-10% of total earnings to cover any upfront costs.

Competition law and pricing – Laws firms and the broader music industry must comply with competition regulations, the failure to comply will lead to large legal fines.

The duties and responsibilities of the profession?

For the purposes of this section, I will be referencing an Interview Alison Stopla took with Paul Rothenburg, founder of the New York and LA-based firm: Rothenburg PC. Each excerpt taken from this Interview will be followed by a brief description of what duties/ responsibilities are being represented.

As a Lawyer, we’re handling all their transactional entertainment deals, including record deals, publishing deals, sponsorship and endorsement deals, merchandising agreements, touring and other appearance agreements, licensing agreements, management agreements, acting agreements, and any agreements related to their release of music, including Producer, side artist, Writer and sample agreements. “Those are the core agreements for a successful recording artist.

Drafting and reviewing documents – Creating and checking contracts for clients, which can cover a wide range of agreements. For brevity’s sake I will not repeat the afore mentioned list of agreements.

Negotiating deals – Working on the finer points of an agreement to secure the best terms for clients, ensuring fair compensation, and protecting their rights.

Our clients typically consult us for anything else of a legal or business nature. If there’s a lawsuit and we need a litigator, we’ll find the right person for the matter in question. If they get accused of something, we engage a Criminal Attorney if necessary.

Client communication – Staying in touch with clients through calls and emails to advise them, answer questions, and manage their legal needs.

Sometimes it’s a prenuptial agreement or other family law-related matter, or it could involve a real estate purchase or estate planning. I am the liaison for all these things they might need. Our core expertise is in entertainment but as part of the service we provide, if our clients need anything of a legal nature, it’s our job to find them the best person, and make sure that they’re treated well and prioritized, and that they pay a fair price.

Legal research – So as to better advise clients on how to protect their work and navigate related legal matters.

Career-progression/development opportunities are available within the profession?

Experienced music lawyers have many career-progressions/ development opportunities available to them.

Partnership – The most common career path taken by many lawyers is to become a partner in a law firm. A law firm partner is a senior ranked lawyer who has a partial stake in the firm. “A partner is entrusted with the responsibilities of the optimal functioning and generation of a law firm’s revenue.” (Nwabueze, C. n.d). Alongside this duty a partner often takes on the responsibility of hiring trainee and newly qualified solicitors, along with acting as their mentor.

General Counsel / Chief Legal Officer – For lawyers that work “in-house” for record labels, publishers, or promoters, becoming the head of the legal department of that company is another career progression available to them. A CG or CLO usually occupy that role. A General Counsel (GC) deals with legal and compliance affairs, ensuring adherence to applicable laws and regulations, while a Chief Legal Officer (CLO) assumes leadership over all aspects of legal affairs, from risk management and compliance to dispute resolution.

 Specialization – Most lawyers looking to advance their careers would stand to benefit from developing niche expertise in a specific area of law, for instead touring law, posthumous rights management, or IP rights monetization. Specialising in any of these would make any lawyer a valuable asset to a firm and could potentially open up specialized consulting roles.  

Mediation/Arbitration – Any experienced legal professional might choose to move into alternative dispute resolution (ADR) as the name may suggest they function as mediators or arbitrators within the industry.

Artist Management/A&R – Lawyers with a passion for helping new artists will typically transition into artist management or A&R (Artist & Repertoire) roles. Leveraging their industry connections and understanding of career development to help advances the careers of their clients.
